User Agreement

Please be sure to carefully read and understand all rights and restrictions set forth in this User Service Agreement (hereinafter referred to as "Agreement"). Unless you accept the terms of this Agreement, you are not authorized to register, log in, or use the services covered by this Agreement. This Agreement is a legal agreement between the User and Ducky Notes-Cute Diary.

1. Service content

1.1Ducky Notes-Cute Diary is the owner and operator of the app, and provides Internet-based and mobile Internet-related services (hereinafter referred to as network services) in full accordance with its published terms of service and operating rules.

1.2 The user understands and accepts that Ducky Notes-Cute Diary only provides the relevant network services, except for the equipment related to the relevant network services (such as personal computers, cell phones, and other devices related to accessing the Internet or mobile Internet) and the required fees (such as telephone and Internet fees paid for accessing the Internet and cell phone fees paid for using the mobile network), which shall be borne by the user.

2. User use rules

2.1 Users must provide accurate personal information to Ducky Notes-Cute Diary when applying for the use of Ducky Notes-Cute Diary network services, and must promptly update any changes in personal information. All consequences arising from inaccurate and untrue personal information provided by the user shall be borne by the user.

2.2 Users should not transfer their accounts, passwords, lend or give them to others in any form out of the user's control. If the User finds that his/her account is being used illegally by others, he/she shall immediately notify. Because of hacking or the user's negligence in keeping the account, password is illegally used by others ,Ducky Notes-Cute Diary does not bear any responsibility.

2.3 Users shall be responsible for all actions under their own registered accounts, and Ducky Notes-Cute Diary shall not be responsible for any loss or damage to the user or any other third party caused by the user's actions.

2.4 The user understands and accepts that the services provided by Ducky Notes-Cute Diary may include advertisements, and the user agrees to display advertisements provided by Ducky Notes-Cute Diary and third-party suppliers and partners in the process of use.

2.5 Users must follow the following principles in the process of using the Ducky Notes-Cute Diary network services.

2.5.1 Compliance with relevant Chinese laws and regulations.

2.5.2 Compliance with all network agreements, regulations and procedures related to the network services.

2.5.3 not to use the network service system for any illegal purpose

2.5.4 not to use the Ducky Notes-Cute Diary network service system for any behavior that may adversely affect the normal operation of the Internet or mobile network

2.5.5 Shall not use the network service provided by Ducky Notes-Cute Diary to upload, display or disseminate any false, harassing, libelous, abusive, threatening, vulgar and obscene or any other illegal information materials.

2.5.6 not to infringe the patent, copyright, trademark, reputation or any other legal rights and interests of Ducky Notes-Cute Diary and any other third party.

2.5.7 shall not use the Ducky Notes-Cute Diary network service system to carry out any behavior that is detrimental to Ducky Notes-Cute Diary.

2.5.8 If you find any illegal use of user accounts or account security vulnerabilities, you should immediately notify the love of duck journal.

2.6 If the user violates any of the above provisions in the use of network services, Ducky Notes-Cute Diary or its authorized person has the right to require the user to correct or directly take all necessary measures (including but not limited to changing or deleting the user's favorite content, etc., suspend or terminate the user's right to use network services) to mitigate the impact of the user's misconduct.

3. Service change, interruption or termination

3.1 In view of the special nature of the network services, the user agrees that Ducky Notes-Cute Diary has the right to change, interrupt or terminate some or all of the network services at any time according to the business development without notice to the user and without any responsibility to any user or any third party.

3.2 The user understands that Ducky Notes-Cute Diary needs to regularly or irregularly overhaul or maintain the platform (such as Internet website, mobile network, etc.) or related equipment for providing network services, and if such circumstances cause interruption of network services within a reasonable period of time, Ducky Notes-Cute Diary shall not bear any responsibility for this, but Ducky Notes-Cute Diary shall give prior notice as far as possible.

3.3 If any of the following circumstances occur, Ducky Notes-Cute Diary has the right to interrupt or terminate the provision of network services (including paid network services) under this Agreement to the User at any time without any liability to the User or any third party.

3.3.1 The personal data provided by the user is untrue.

3.3.2 The User violates the rules of use set forth in this Agreement.

4. Intellectual Property Rights

4.1 Any text, images, graphics, audio and/or video materials contained in the Web Services provided are protected by copyright, trademark and/or other property ownership laws, and none of the foregoing may be used for any commercial purpose without the consent of the relevant right holder.

4.2 All rights in any software (including but not limited to any images, photographs, animations, videos, sound recordings, music, text and additional programs, accompanying help materials) used for the provision of the Network Services belong to the copyright owner of such software and the User shall not reverse engineer, decompile, or otherwise use the software without the permission of the copyright owner of such software. You may not reverse engineer, decompile or disassemble the Software without the permission of the copyright owner.

5. Privacy protection

5.1 Protection of user privacy is a basic policy of Ducky Notes-Cute Diary, Ducky Notes-Cute Diary guarantees not to disclose or provide to third parties the registration information of individual users and the non-public content stored in Ducky Notes-Cute Diary when users use the network services, except for the following cases.

5.1.1 Prior express authorization from the user.

5.1.2 In accordance with the requirements of the relevant laws and regulations.

5.1.3 In accordance with the requirements of the relevant governmental authorities.

6.1 Ducky Notes-Cute Diary does not guarantee that the network service will meet the user's requirements, nor does it guarantee that the network service will not be interrupted, nor does it guarantee the timeliness, safety and accuracy of the network service.

6.2 Ducky Notes-Cute Diary does not guarantee the accuracy and completeness of the external links set up to provide convenience to users, and at the same time, Ducky Notes-Cute Diary does not assume any responsibility for the content on any web pages pointed to by such external links that are not actually controlled by Ducky Notes-Cute Diary.

6.3 For losses arising from telecommunications systems or Internet network failures, computer failures or viruses, information damage or loss, computer system problems or any other force majeure reasons, Ducky Notes-Cute Diary does not assume any responsibility, but will try to reduce the losses and impacts caused to users as a result.

7. Law and Dispute Resolution

7.1 The laws of the People's Republic of China shall apply to this Agreement.

7.2 Any dispute arising out of or in connection with this Agreement shall be settled by friendly negotiation between the parties; if such negotiation fails, either party may submit the dispute to the Nanjing Arbitration Commission and arbitrate it in accordance with its arbitration rules in force at the time; the arbitral award shall be final and binding on the parties.

8. Other Provisions

8.1 If any provision of this Agreement is, for whatever reason, wholly or partially invalid or unenforceable, or violates any applicable law, such provision shall be deemed deleted, but the remaining provisions of this Agreement shall remain valid and binding.

8.2 Ducky Notes-Cute Diary has the right to modify this Agreement at any time in accordance with changes in relevant laws and regulations and adjustments to the Company's business conditions and business strategies, etc. without separate notice to the User. Users may view the latest terms of service agreement through the app at any time. In case of dispute, the latest agreement text shall prevail. If you do not agree with the changes made to the terms and conditions of this agreement, you have the right to stop using the app service. If the user continues to use the app service, the user is deemed to accept the modifications made by Ducky Notes-Cute Diary to the relevant terms and conditions of this agreement.

8.3 Ducky Notes-Cute Diary has the right to interpret and amend this Agreement to the maximum extent permitted by law.
